Guiding your Guardianship Clients (2018)
The initial meeting with a prospective client in a guardianship proceeding can be challenging. Not only is the attorney required to evaluate the merits of the case but you are also deciding whether or not you want to take on representation of the future fiduciary. This session will illustrate how to approach this meeting and how to determine whether or not your client is up to the task of serving in this role, and will additionally address early issues such as proper handling of the notice and service requirements while balancing complex family dynamics.
