Special Needs Planning in the Context of Divorce (2010)

Session from 2010 Special Needs Summit presented by Harry Margolis, Esq. and Franchelle Millender, CELA, CAP. Marriages of parents who have a child with special needs end in divore at a higher rate than those of couples without children or whose children do not have special needs. Not only do the needs of such children put higher stresses on their parents while they are married but they compound the issues already present in any divorce, including more complicated custody issues and more extensive care costs. The program covers eligibility for public benefits and proper classification of child support payments; Coordinating estate plans of both parents to provide for children with special needs; legal obligation of support surviving emancipation for children with special needs; providing for guardianship and custody of the child as well as the relationship between guardians and trustees; and fostering communication between parents for the welfare of the child with special needs.
