Must Sole Benefit Trusts Contain Payback Provisions?

A sole benefit trust (SBT) is a powerful but misunderstood tool in the Medicaid planning toolbox. A common error (either by practitioners or imposed by state agencies) is the notion that an SBT must provide reimbursement to the state for Medicaid benefits paid to the beneficiary upon the death of the beneficiary (or a “payback provision”). As this webinar will explain, most SBTs need not contain a payback provision. To get the most out of this Lunch & Learn, we encourage you to read his article first.
