This week at the the National Association of State Treasurers (NAST) legislative conference, NAELA's Director of Advocacy, David M. Goldfarb, joined a panel to discuss a proposal to allow Social Security representative payees (rep payees) to be defined as someone's "authorized legal representative" for an ABLE Account. That means someone's rep payee would have full control over the private funds in an ABLE account. NAST members are responsible for the administration of ABLE programs. The proposal to let rep payees control ABLE Accounts is presently under consideration by the organization. NAELA raised several concerns including a lack of due process, lack of a system of checks and balances, and lack of statutory authority for rep payees to control private funds of a Social Security beneficiary.
