NAELA Watching New Maine Governor's Next Steps After Annuity Limits Approved By CMS

On December 21st , CMS approved several harmful Section 1115 waivers including in Maine. NAELA remains extremely concerned about this waiver because it would impose limits for the first time on Section 1917 of the Social Security Act, specifically limits to Medicaid compliant annuities. While NAELA had some success, CMS modified the proposal to add additional protections. The ability to waive Section 1917 is extremely dangerous. The new Governor of Maine, who took office last week, previously called the waiver "inhumane," but recently struck a more cautious tone, focusing on the need to assess her legal obligations.
