The developing law regarding the rights and abilities of persons with disabilities to make decisions about their health care, particularly at the end of life, is influenced by jurisprudential, political, ethical, cultural and medical considerations. This workshop explores the rights of individuals with disabiliies to self-determination in medical decision making by considering concepts and measures of capacity to make such decisions and through discussion of the various roles of families, health care providers, courts, substitute decision makers, and written advance plans. The often conflicting political and ethical viewpoints of some disability activists and civil libertarians provides a background for the discussion. How do the rights of persons with severe disabilities to treatment and preservation of life interact with their right to refuse unwanted treatment? This workshop explores this dilemma.
