Aspirational Standards


NAELA's Aspirational Standards for the Practice of Elder and Special Needs Law Attorneys was created as a guide for members in negotiating for and protecting their clients. Elder law and special needs planning attorneys are bound by their state’s Rules of Professional Conduct, but the legal affairs of this group can be more complex and additional consideration is required in meeting the needs of clients. Our Aspirational Standards involve:

  • Working in the client's best interest
  • Maintaining confidentiality
  • Transparency with clients
  • Communication, advocacy and public service
  • Avoiding conflicts of interest

Attorneys who meet these Standards elevate their level of professionalism in the practice of Elder Law and Special Needs Planning, and enhance the quality of service to their clients. As a condition of membership, an attorney must pledge to support the Aspirational Standards for the practice of Elder and Special Needs Law.
