In this matter, the requesting attorneys believe Iowa Code Section 249F and Iowa Administrative Code Section 441-89 deprives the plaintiffs of certain rights under 42 USC Section 1396p and want to enjoin the defendants from seeking recovery of assets transferred to plaintiffs by their mother, who was a recipient of Medicaid from the Iowa Department of Human Services. If successful, the litigation would prevent the Iowa Department of Human Services from "double penalizing" Medicaid applicants by enforcing a penalty period for gift giving within five years prior to the application and then trying to collect those gifts once the Medicaid applicant has passed and they are trying to collect on their outstanding bill. This will ensure that the citizens of Iowa have the opportunity to take advantage of the gift plus annuity strategy for Medicaid planning, as is permitted in other states. The Board of Trustees approved a $10,000 grant in support.
