The NAELA Foundation promotes the goals of NAELA and the elder law and special needs planning profession through regulatory advocacy, litigation, research, scholarships, and education.

Litigation and Regulatory Advocacy

We are at a time in history where the benefits our clients have earned are facing significant pressures at the federal and state level. 

The Litigation and Regulatory Advocacy Fund’s objective is to advocate for and establish good legal precedent in matters of critical importance to older Americans and people with disabilities. The Foundation’s grants have resulted in setting legal precedent in key areas of the law, collaborating with organizations seeking NAELA’s support, and providing educational opportunities on topics important to NAELA members and their clients. Moreover, the Foundation has served as a national voice to safeguard the interests and benefits of seniors and people with disabilities.  

By donating, NAELA members ensure that the Foundation has the resources necessary to support NAELA, state chapters, and other nonprofit organizations which advocate and facilitate litigation that ensures our most vulnerable benefit from the services they need and deserve.

 

Help Support Priority Litigation

  • Community Integration: Working to uphold the right of people with disabilities to access care in community settings.
  • Supplemental Needs Trusts: Combatting unjustified limits to these trusts to maximize the independence and dignity of people with disabilities 
  • Medicaid Eligibility. Fighting the abuse of Section 1115 Waiver authority and other attempts to restrict access to this vital program.

Give to Other Areas of Action:

  • Protecting the rights of long-term care facility residents, particularly in light of the COVID-19 crisis 
  • Increasing awareness of elder abuse, neglect and exploitation
  • Protecting Medicare benefits, such as the right to skilled care based on patient need, not to potential for improvement

The Foundation created a Litigation and Regulatory Advocacy Fund with the objective of establishing good legal precedent in matters of critical importance to older Americans and people with disabilities  and established a process to review grant applications
