The New Jersey supreme court’s decision to allow children with disabilities of retired police and firefighters to receive their parent’s survivor benefits without the risk of losing public assistance was in part due to the assistance of the National Academy of Elder Law Attorneys (NAELA) and NAELA members.

The NAELA Foundation awarded $25,000 to the Center for Medicare Advocacy (CMA) to support litigation to prevent erroneous denial of Medicare coverage, provide access for beneficiaries to an effective appeals system and, therefore, access to Medicare coverage and necessary health care.

The Centers for Medicare and Medicaid Services recently issued a letter on estate recovery to State Medicaid Directors confirming that people eligible for Medicaid under the ACA who were 55 or over when they received Medicaid are “not exempt from the estate recovery provision in Section 1917(b)(1)(B).”

NAELA Commends Supreme Court’s Decision on DOMA
The Supreme Court’s decision on the Defense of Marriage Act (DOMA) will extend the spousal benefits of Social Security and Medicare to many married same-sex couples. Further, long-term care spousal impoverishment protections under Medicaid also will be extended, and legally married, same-sex spouses of deceased veterans will be eligible to receive veterans’ benefits.

Lynne Bayes-Weiner, of Overland Park, Kan.; and Elizabeth Bertrand, of Orlando, Fla., as the 2013 recipients of the Cohn Sisters’ Scholarships for Patient Advocacy. The scholarship was established through the NAELA Memorial Fund in memory of Vivian Cohn Smith and Lorrie Cohn, sisters of NAELA Fellow Helen Cohn Needham.  This annual scholarship is available to Elder Law attorneys who are unable to afford to attend a NAELA Annual Conference, and who would use the training to assist and advocate on behalf of people with disabilities.

As a result of the ruling  written by Chief Justice John Roberts, millions of Americans are expected to get insurance coverage under mandates beginning in 2014. NAELA applauds this decision, which will not only preserve the Act’s many benefits for older Americans and people with special needs, but also benefit currently uninsured Americans.

NAELA, along with members of the Leadership Council of Aging Organizations (LCAO), met with Marilyn Tavenner, the new Acting Administrator of the Centers for Medicare and Medicaid Services (CMS), and reiterated their opposition to a Florida waiver proposal to require frail and vulnerable adults who receive Medicaid for long-term services and supports to enter into a private, managed care program.
